1The applicants have filed 81 Applications alleging that the survivor benefit provisions of the Ontario Teachers’ Pension Plan discriminate against each of them on the basis of sex and marital status contrary to sections 1, 5(1), and 9 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2The respondent, the Ontario Teachers’ Pension Plan Board (“OTPPB”), has filed a Request for an Order During Proceedings (“RFOP”) seeking the early dismissal of the Applications pursuant to section 34(1) of the Code. The OTPPB states the Applications were filed outside the limitation period.
3Following a case conference, the parties agreed that file number 2011-08892-I, Ontario Teachers Survivor Benefit Group on behalf of Matthew O’Flanagan, will proceed as a lead case on the issue of delay.
4In a Case Assessment Direction (“CAD”) dated November 22, 2011, the Tribunal wrote:
In the circumstances, it appears that it would be appropriate to hold in abeyance the remaining 80 Applications pending the determination of the RFOP as it relates to the O’Flanagan Application. Within five days of this Caes Assessment Direciton, any party objecting to the remaining Applications being held in abeyance on these terms may deliver to the other parties and file with the Tribunal written submissions in this respect.
5None of the parties has filed written submissions in response to the CAD. In the circumstances, I am satisfied that it is appropriate to hold the remaining Applications in abeyance.
6Accordingly, the Applications (with the exception of the O’Flanagan matter) will be held in abeyance pending the Tribunals’ determination of the RFOP regarding delay.
