1This is an Application filed on April 5, 2011, under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination in employment on the basis of race, colour, ancestry, place of origin, ethnic origin and age. The Tribunal granted the respondents’ request for a Summary Hearing by Case Assessment Direction dated July 12, 2011. The Summary Hearing is scheduled to be heard on February 6, 2012 via telephone conference.
2This Interim Decision addresses a Request by the applicant for an Order During Proceedings (the “Request”) filed on November 3, 2011 to amend his Application to vary the remedies sought and to include an allegation of resprisal. These new allegations are attached to the Request for Order and are entitled Appendix “A”.
3The respondents have indicated in their response to the Request filed on November 15, 2011 that they consent to the amendment of the Application on the condition that they have the opportunity to respond to the amendements.
Order
4The Tribunal orders the following:
a. The Application is amended to include the allegations set out in Schedule “A” as attached to the applicant’s Request;
b. The respondents may file a response to the allegations set out in the applicant’s Schedule “A” by no later than January 6, 2012.
