1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on May 16, 2011.
2In September 2011, the Tribunal conducted a mediation check to determine if the parties were interested in participating in mediation. By way of response, the applicant wrote to the Tribunal on September 26, 2011, indicating, “I cannot deal with this case at this time. As such, do whatever you think is right. Thanks.”
3By letter dated October 19, 2011, the Tribunal requested that the applicant clarify her intentions with respect to the Application, as follows:
By October 29, 2011, the Applicant must advise the HRTO and the respondent in writing whether he / she intends to proceed with this Application.
4To date, the applicant has not responded to the Tribunal’s letter.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
