1The applicant filed an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), alleging discrimination on the basis of race, colour, place of origin and reprisal or threat of reprisal in the area of employment from January 2009 to October 2009.
2A hearing was convened for September 16, 19 and 20th, 2011. After hearing the applicant’s evidence, the Tribunal sought submissions from the parties whether the applicant had set out a prima facie case of discrimination. Following a break for preparing submissions, the applicant agreed that there was no reasonable prospect of success of the Application and sought to withdraw the Application.
3The respondent sought assurance that the withdrawn Application could not be renewed in a future proceeding.
4The Application is dismissed on the basis of the applicant’s request to withdraw and the respondent’s request that this matter be finally disposed of.
