INTERIM DECISION
Adjudicator: Naomi Overend
Indexed as: Romero v. Mennonite Brethren Senior Citizens Home
1The purpose of this Interim Decision is to address the applicant’s Request for an Order During Proceeding (Form 10) seeking production of documents from the respondents.
2The applicant filed her Application on March 19, 2009, alleging discrimination and harassment in employment contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). On August 10, 2011, the Tribunal issued a Notice of Confirmation of Hearing. This Notice indicated that by August 31, 2011, the parties were required to deliver to each other a list of all arguably relevant documents and a copy of each document contained on the list, except those over which privilege was being claimed.
3The applicant complied with this requirement in a timely fashion. The respondents apparently have not. On October 24, 2011, the applicant filed a Request for Order During Proceedings (Form 10) seeking an order that the respondents comply with this requirement. The respondents appear not to have filed any Response to the Request for Order (Form 11).
4Rule 16.1 of the Tribunal’s current Rules of Procedure set out the requirements which mirror those found in the Notice of Hearing. The respondents have not indicated to the Tribunal that they have complied with this requirement. Accordingly, I order that the respondents comply with the requirement under Rule 16.1 within one week of the date of this Interim Decision.
5I am not seized of this matter.
Dated at Toronto, this 1st day of December, 2011.
