1This is an Application filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the "Code").

2The Tribunal scheduled a hearing for October 21, 2011 to hear the Application. The respondent and representatives of the respondent appeared but the applicant did not appear.

3On review of the Tribunal's records I was concerned that it was possible that the applicant had not received notice of the hearing.

4A Case Assessment Direction was issued on October 24, 2011. It provided as follows:

This Case Assessment Direction will be sent to the applicant based on the contact information and alternate contact information she has provided to the Tribunal. Within three weeks of the date of this Case Assessment Direction the applicant must confirm that she intends to participate in a hearing. If the applicant does not respond within three weeks, the Application may be dismissed.

5The three week period has now elapsed. The Tribunal has not received any communication from the applicant. It appears that the applicant has decided not to pursue the Application.

6The Application is therefore dismissed as abandoned.
