INTRODUCTION
1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), and a hearing has been scheduled in Toronto on November 25, 2011.
2In an e-mail dated October 25, 2011, the Tribunal was advised that the applicant had suffered a stroke on October 13, 2011, and that she did not know if she would be able to attend and participate at the hearing. On November 7, 2011, the Tribunal was advised that the applicant would likely remain hospitalized for the remainder of the year and she requested that the hearing be rescheduled to the summer of 2012.
3On November 1, 2011, the respondents advised the Tribunal that they would not oppose the applicant’s request to adjourn and reschedule the hearing.
4Based on the foregoing, there are exceptional circumstances which warrant the adjournment of the scheduled hearing. The Tribunal Orders that the hearing scheduled on November 25, 2011 is cancelled. The Tribunal directs the Registar, in the January 2012, to canvass the parties’ availibilty for a one day hearing in Toronto in June or July of 2012.
