Reasons for Decision
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on March 4, 2010.
2The Tribunal sent the parties a Confirmation of Hearing notice by e-mail on June 10, 2011. The notice informed the parties that the Tribunal had scheduled a hearing of the Application on November 14 and 15, 2011 at 655 Bay Street, 14th Floor, Toronto, Ontario, commencing at 9:30 AM. I am satisfied that the parties had notice of the hearing.
3Neither party was in attendance at the commencement of the scheduled hearing. In accordance with its usual practice, the Tribunal waited until 10:00 AM. By 10:00 AM, neither party had communicated with the Tribunal to explain the failure to attend.
4In the circumstances, the applicant is deemed to have abandoned the Application, and the Application is dismissed.
