1On January 29, 2011 the Tribunal issued an Interim Decision in this matter in which I found that it appeared to me that the Ontario Human Rights Commission had never obtained the consent of the Monitor of the respondent or leave of the Ontario Superior Court of Justice to refer the complaint to the Tribunal. The parties were directed to provide submissions to the Tribunal as to why the complaint should not be dismissed on the basis of those findings within 14 days from the date of the Interim Decision.
2No submissions were made. As a result, I find, for the reasons set out in the previous Interim Decision, that this complaint cannot proceed and it is hereby dismissed.
