Decision
1This is an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the “Code”) alleging discrimination in employment on the basis of disability and reprisal.
2The Tribunal scheduled a hearing for October 12, 2011 commencing at 9:30 a.m. at the Tribunal’s hearing centre in Toronto.
3The applicant was not present at the hearing. Where a party does not attend a scheduled hearing, the Tribunal may proceed in the party’s absence (Rule 3.13 of the Tribunal’s Rules of Procedure). In accordance with its usual practice, the Tribunal waited until 10:05 a.m. before proceeding. I informed the respondents that I was dismissing the matter as abandoned with a written decision to follow and I excused the respondents at 10:10 a.m.
4I am satisfied that the applicant had timely notice of the hearing. On May 14, 2011, the Tribunal sent by mail a Notice of Confirmation of Hearing to the applicant’s address noted in the Tribunal File and the document was not returned to the Tribunal.
5In view of the applicant’s non-attendance at the hearing, the Application is dismissed as abandoned.
