Adjudicator: Leslie Reaume Date: October 13, 2011 File Numbers: 2011-09459-I; 2011-09468-I; 2011-09536-I Citation: 2011 HRTO 1853 Indexed as: Bartello v. West Nipissing Police Service
1These seven Applications filed under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), allege discrimination in the provision of service on the basis of a number of prohibited grounds.
2By Case Assessment Directions dated October 26, 2010, January 26, 2011, and September 6, 2011, the Tribunal, on its own initiative, directed that the matters be heard together and scheduled for a Summary Hearing pursuant to Rule 19A of the Tribunal’s Rules of Procedure.
3Prior to the commencement of the hearing on the morning of October 12, 2011, the applicants sent an email to the Registrar of the Tribunal advising that they did not intend to participate in the hearing. The teleconference took place at 9:30 AM on October 12, 2011, without the applicants in attendance and counsel for the respondents did not oppose the dismissal of the Applications.
4I am satisfied that the applicants had notice of the hearing.
5In the circumstances, the Applications are dismissed on the basis that the applicants were deemed to have abandoned the Applications.
Dated at Toronto, this 13th day of October, 2011.
