1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended.
2On June 17, 2010, the Tribunal issued an Interim Decision in 2010 HRTO 1371 dealing with the effects of proceedings in bankruptcy in respect of the respondent. The Tribunal specifically directed as follows:
…The Application may not proceed against the respondent at this time. The applicant is directed to advise the Tribunal within one year of the date of this Interim Decision whether he has lifted the stay or taken other steps to enable his Application against the respondent to proceed. If the applicant fails to do so, the Tribunal may deem the Application abandoned and close its file.
3The applicant has not advised the Tribunal in accordance with the Interim Decision nor has the applicant otherwise communicated with the Tribunal and the time for doing so has now passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
