1This is an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended. The applicant alleges discrimination because of disability, contrary to s. 1 of the Code as a result of the amount of the special diet allowance she is receiving under the Ontario Disability Support Program.
2The Social Benefits Tribunal and the Ontario Disability Support Program were originally named as respondents. In a Case Assessment Direction dated July 8, 2011, the Tribunal directed that the Social Benefits Tribunal would be removed as a respondent if the applicant did not make submissions within 21 days in support of any argument that the Application should continue as against it. The Tribunal also directed that any party opposed to amending the name of the respondent Ontario Disability Support Program to “Her Majesty the Queen in Right of Ontario as represented by the Minister of Community and Social Services” make submissions within 21 days.
3No party made submissions on either of these issues. The Social Benefits Tribunal is removed as a respondent and the name of the respondent Ministry is corrected as set out in the style of cause above.
4To assist the Tribunal in making directions on the next steps in the Application counsel for the respondent Ministry is requested to deliver to the applicant and file with the Registrar within 30 days of the date of this Interim Decision: (i) a copy of the applicant’s special diet allowance application forms from April and June 2010, (ii) a copy of any subsequent special diet allowance forms filed by the applicant, and (iii) information about the applicant’s current special diet allowance, if any.
5Counsel for the respondent is not required to file a Response. A copy of this Interim Decision will be sent to all counsel who received the Tribunal’s Case Assessment Direction.
