1A teleconference case management hearing was convened in these matters on August 25, 2011 at which I made the following oral orders/directions:
a. The hearing in Application 2009-03189-I, which is proceeding on September 6 and 7, 2011, will be bifurcated. The parties will deal with the merits, but not the remedy portion of the Application, on those days.
b. I am seized with respect to Application 2010-06415-I. The parties advise that this Application has not yet proceeded to mediation and are encouraged to seek an early date with respect to that step. In the event that this matter is not resolved through mediation, the hearing on the merits in Application 2010-06415-I will proceed at a subsequent date.
c. Should it be necessary to address the issue of remedy, the parties or the Tribunal, on its own initiative, may renew the request to consolidate the two Applications with respect to the remedy portion.
d. On consent, the Canadian Union of Public Employees (CUPE) – Ontario Regional is removed as a respondent to Application 2010-06415-I. The style of case is amended accordingly.
e. The Tribunal will deal with the Request for Order During Proceedings (Form 10) to remove CUPE National as a respondent to Application 2010-06415-I in writing. The applicant has until September 22, 2011 to serve on the respondents and file with the Tribunal any supplementary written submissions on the Request. The respondents have an additional two weeks from the date of receipt of the applicant’s submissions to file any response submissions.
