1In this complaint, the Ontario Human Rights Commission has filed a Request for Order during Proceedings, dated July 24, 2009 seeking an order "acknowledging the Commission's withdrawal from the proceeding, and finding that the withdrawal does not give rise to transitional issues and need not be the subject of any conditions."
2In support of its Request, the Commission stated, among other things, that it was re-sending its disclosure package to the complainant and respondents and would provide confirmation to the Tribunal of the same. The Commission's Request remained outstanding as the Tribunal had not received confirmation of the foregoing.
3In a Case Assessment Direction dated June 30, 2011, the Tribunal directed that the Commission confirm that it provided a copy of the disclosure material to all respondents by July 18, 2011.
4In a letter dated July 27, 2011, the Commission advised the Tribunal in writing that it provided the individual respondents with a copy of the disclosure and production of all non-privileged information gathered in the investigation. On August 2, 2011, the Commission provided confirmation of the same to the complainant.
5The Request was served on the other parties, none of whom have responded. Further no request has been made for any transitional directions and I am satisfied that none are required.
6Having regard to the material before me, I allow the Commission's Request to withdraw.
