1This Application, filed under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), alleges discrimination in employment on the basis of disability.
2A hearing in this matter was scheduled for August 11, 2011 by way of a Confirmation of Hearing Notice ("the Notice") sent by the Tribunal to the parties on March 18, 2011. The Notice advises the parties that the hearing would commence at 9:30 am on August 11, 2011 at 655 bay St., 14th floor, Toronto, Ontario.
3The Notice was sent by mail to the applicant at the address that the applicant provided on her Application.
4The applicant did not appear at 9:30 a.m. on August 11, 2011 for the commencement of her hearing. The respondents were present. At 10:15 a.m. the applicant was still not present and had not contacted the Tribunal to explain her absence.
5I am satisfied that the applicant received timely and proper notice of the hearing. Based on having received proper notice of the hearing the applicant should have appeared for her scheduled hearing.
6In view of the applicant's non-attendance at the hearing, the Application is dismissed as abandoned.
