1The applicant filed an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"), on February 9, 2009. After a hearing on the merits, the respondent was found, in a Decision dated February 4, 2010, to have breached the Code: 2010 HRTO 256 ("the original Decision"). I remained seized for the purposes of implementation. A Request for Reconsideration of the Tribunal's Decision was dismissed on May 14, 2010; 2010 HRTO 1080.
2On November 16, 2010, counsel for the applicant wrote to the Tribunal to request that the matter be reconvened
(...) to assess what additional remedies" should be ordered against the respondent "for failure to abide by the Order of this Tribunal. (....)
The Applicant submits that the Respondent has wilfully breached the order of the Tribunal and the Tribunal must act to ensure that its Orders are acted upon.
3By letter dated July 18, 2011 and copied to the respondent and its counsel, counsel for the applicant wrote to the Tribunal indicating that the applicant had moved from the respondent's premises and no longer wished to pursue her request. Accordingly, the Tribunal will consider the request withdrawn and close the file.
