1This is an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code") alleging discrimination in services on the basis of race, colour, place of origin, ethnic origin, disability, family status, marital status and age.
2The Tribunal scheduled a hearing for July 25, 2011 commencing at 9:30 a.m. at the Tribunal's hearing centre in Toronto.
3The applicant was not present at the hearing. Where a party does not attend a scheduled hearing, the Tribunal may proceed in the party's absence. In accordance with its usual practice, the Tribunal waited until 10:05 a.m. before proceeding. I informed the respondents that I would dismiss the matter as abandoned with a written decision to follow and I excused the respondents at 10:10 a.m.
4I am satisfied that the applicant had notice of the hearing. The Tribunal sent a Notice of Confirmation of Hearing to the applicant's address listed in the Application and the document was not returned to the Tribunal.
5In view of the applicant's non-attendance at the hearing, the Application is dismissed as abandoned.
