1This Interim Decision deals with a Request for Order During Proceeding (Request) filed by the applicant filed on January 18, 2011. The respondents were not required to respond to the Request.
2In her Request the applicant’s seeks an Order consolidating her transition Application, Tribunal File TR-0736-09, made under s. 53(5) of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the Code), with her Application, Tribunal File 2010-05953-I, brought under s.34 of Part IV the Code. No reasons are provided by the applicant for the Request other than that she has made a similar and broader Request to have a number of Applications consolidated.
3The Request to consolidate is rejected. The s. 34 Application was heard on November 8, 2010 pursuant to Rule 19A of the Tribunal’s Rules of Procedure for Applications under Part IV of the Code and a decision is pending. The s. 34 Application relates to another respondent and relates to events different from and post-dating the issues raised in the s. 53(5) Application. In any case, it would be inappropriate to consolidate two Applications where the other hearing has begun and a potentially final decision is pending.
