1This is an Application filed on April 29, 2011 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On June 7, 2011, the Tribunal sent a Notice of Incomplete Application and Notice of Intent to Dismiss Application (“Notice”) to the applicant. The Tribunal directed the applicant to provide information missing from the Application form. Further, the Tribunal directed the applicant to provide submissions on the issue of whether the Application should be dismissed as against Roger Strasser. The Tribunal indicated that a review of the Application and the narrative setting out the incidents of alleged discrimination fails to identify any specific acts of discrimination within the meaning of the Code allegedly committed by this individual.
3The applicant responded to the Notice. Based on his submissions, it is not plain and obvious that the Application as against Roger Strasser should be dismissed at this stage as being outside the Tribunal’s jurisdiction. This finding is not a determination of the merits of the claim against any of the respondents, nor is it a finding that Roger Strasser is an appropriate personal respondent having regard to the principles set out in Smyth v. Toronto Police Services Board, 2009 HRTO 1513.
4The Tribunal will issue the Notice of Application.
