BACKGROUND
1The applicant filed an Application under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the “Code”) on October 4, 2010. The respondents filed Responses in April 2011.
2On May 11, 2011, The Tribunal sent the applicant a copy of a Notice of Incomplete Response to the postal address provided in the Application. On May 24, 2011, the correspondence was returned to the Tribunal by Canada Post marked as undeliverable.
3The applicant provided no telephone contact number on the Application. The applicant did, however, provide an email address in the Application. On June 7, 2011, an email was sent to the applicant by the Tribunal informing him that mail sent to him by the Tribunal via Canada Post had been returned, and directing him to provide the Tribunal with a current postal address.
4A subsequent email was sent to the applicant on June 20, 2011 by the Registrar again directing the applicant to advise the Tribunal of his current postal address. The applicant was further advised that if he did not respond by June 24, 2011, the Tribunal would deem the Application abandoned and the close its file.
5The applicant has not responded to the Tribunal’s email correspondence.
DECISION
6Rule 5.4 of the Tribunal’s Rules of Procedure provide:
The Tribunal may finally determine an application without further notice to any person who cannot be contacted by the Tribunal according to the contact information provided by the Tribunal by that person.
7In the circumstances, the applicant is deemed to have abandoned the Application.
ORDER
8The Application is dismissed.
