1This is an Application filed on March 29, 2010 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the “Code”). The Tribunal scheduled a conference call hearing for Monday, January 17, 2011, starting at 9:30 a.m., to receive the submissions of the parties on the issue of the timeliness of the Application.
2The respondent participated in the conference call. The applicant did not appear. The Notice of Confirmation of Hearing was sent to the parties on November 15, 2010. No mail has been returned. I am satisfied that the applicant received notice of the conference call hearing. The Notice advises the applicant that if he fails to attend the hearing after receiving proper notice the Tribunal may proceed in this absence.
3In the circumstances, the Tribunal finds that the applicant has abandoned the Application and it is accordingly dismissed.
