1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on November 4, 2009 and the respondent filed a Response on January 11, 2010. This application is scheduled for hearing on July 11 and 12, 2011.
2The Tribunal’s Rules of Procedure require parties to disclose documents they intend to rely on along with a witness list and witness statement not later than 45 days prior to the first scheduled day of hearing. The applicant failed to comply with this requirement. On June 3, 2011 the Tribunal issued a Case Assessment Direction which directed the applicant, within seven days, to deliver to the respondent a list and copies of all arguably relevant documents in his possession, and to deliver to the respondent and file with the Tribunal all documents he intends to rely upon, a list of witnesses and witness statements. The Tribunal states at paragraph 4 of this Case Assessment Direction:
If the applicant does not comply with this obligation within seven days of this Case Assessment Direction or otherwise communicate with the Tribunal, the Application may be dismissed as abandoned.
3The applicant has not filed with the Tribunal any documents, list of witnesses and/or witness statements, nor has he otherwise communicated with the Tribunal. In the circumstances, the applicant is deemed to have abandoned the Application.
4The Application is dismissed and the scheduled hearing dates are therefore cancelled.
