1This Application was deferred by way of Interim Decision 2010 HRTO 2317 pending the conclusion of a Workplace Safety and Insurance Board (“WSIB”) proceeding.

2On May 27, 2011, the applicant delivered a copy of a decision of a WSIB Appeals Resolution Officer dated April 12, 2011. The applicant requests that the Tribunal reactivate the Application because the WSIB Decision denied the applicant’s claim for loss of earnings benefits and did not recognize a permanent impairment.

3The respondent has not filed submissions in response to the request to reactivate.

4Given that the issues raised in the Application are no longer being considered by the WSIB, it appears that it is appropriate to reactive the Application.

5Accordingly, the Application is reactivated.
