1This Application was filed on December 1, 2010, pursuant to s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the "Code"). The respondent WoodGreen Community Services filed its response on March 15, 2011.
2This Interim Decision addresses a Request by Workers United Ontario Council (the "union") to intervene in this Application. The union is the certified bargaining agent for a unit of employees at the applicant's workplace, which includes the applicant.
3The Request to Intervene was delivered to the applicant and the respondent. Neither party has filed any submissions with respect to the union's request to intervene. Therefore, this request is unopposed.
4In Boyce v. Toronto Community Housing Corporation, 2009 HRTO 131, the Tribunal found that absent exceptional circumstances, the applicant's bargaining agent will be granted intervenor status in Tribunal proceedings where it requests it.
5The Request to Intervene is granted and Workers United Ontario Council is added to this Application as an intervenor. The extent of the union's participation in any future proceedings will be determined by the Vice-chair or Member who presides over those proceedings.
