1This Application was filed on July 23, 2010, pursuant to s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). The respondents filed their response on December 23, 2010.
2This Interim Decision addresses a Request by the applicant for an Order During Proceedings to amend his application to increase the monetary damages sought and to remove N.B. from the style of cause because she was improperly named as an applicant.
3The applicant included in his Request a letter from the respondents’ counsel confirming that they consent to the applicant’s request to amend the Application. In the circumstances, it is appropriate to grant the applicant’s Request to increase the quantum of damages sought and to remove N.B as an applicant.
Order
4In accordance with Rule 3.11.1 of the Tribunal’s Rules of Procedure, the Tribunal will use initials in its decisions to identify a child under age 18, the next friend of that child, and the names of other participants in the proceeding if necessary to protect the identity of the minor child.
5Therefore, the Tribunal makes the following Orders:
a. N.B. is removed as an applicant, and therefore the style of cause shall be amended to “T.B. by his next friend B.B.”;
b. The Application is amended to reflect that the monetary damages sought by the applicant are increased to the quantum identified in the Request; and
c. The respondents may file amended Responses within two weeks of the receipt of this Interim Decision.
