1This is an Application under section 53(5) of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (“the Code”). It was filed with the Tribunal on June 29, 2009. The underlying Complaint to the Commission was filed on June 19, 2007.
2In an Interim Decision dated August 12, 2010, 2010 HRTO 1675 (“McKellar Decision”), the Tribunal dismissed a number of the applicant’s allegations against the corporate respondent on the basis of section 34(11) of the Code. The Tribunal directed that the remaining issues be dealt way of a preliminary hearing. The preliminary hearing commenced May 31, 2011.
3The applicant requested and received a laptop with internet access and a screen as an accommodation for his learning disabilities/communication issues. The Tribunal confirmed with the applicant that he had received the accommodations he requested at the commencement of the hearing.
4During the course of the hearing, the parties agreed to an order dismissing this Application.
5The parties further agreed to consolidation of any outstanding section 34 applications filed by the applicant against the respondents although a search of the Tribunal’s records reveals only one active application (2010-05759-I).
6This Application is dismissed.
