1This Decision arises from a Complaint filed by Jorge Leon (“complainant”) against Woodland Store Fixtures (“respondent”). The complainant alleges discrimination on the basis of disability in the context of his employment contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”). The Complaint was referred to the Tribunal pursuant to section 36(10) of the Ontario Human Rights Code by the Ontario Human Rights Commission (“Commission”) prior to the substantial amendments to the Code which came into force on June 30, 2008.
2The complainant is represented by counsel. The Tribunal held a Pre-Hearing Conference Call on July 10, 2009. Only the Commission appeared on the call. The Tribunal directed that the hearing would commence as scheduled on July 17, 2009 and that it was expected that the complainant would not appear. The Commission confirmed that it would not be adducing any evidence in support of the Complaint. Given those circumstances, the Tribunal directed that counsel for the parties would not be required to appear at the hearing.
3The hearing commenced as scheduled at 9:30 on July 17, 2009. The complainant did not appear. The complainant has had no further correspondence or contact with the Tribunal to date.
4The Complaint is dismissed as abandoned.
