1A Case Assessment Direction issued on June 17, 2010, directed that the Tribunal would deal with these Applications together and that, at the joint request of the parties, the Applications would be adjourned sine die for the purpose of settlement discussions. The requirement to file a Response in Tribunal File No. 2010-05233-I was held in abeyance pending further direction from the Tribunal.

2On June 17, 2011, the applicant requested that the Application in Tribunal File No. 2010-05233-I no longer be held in abeyance. The applicant in Tribunal File No. 2008-00579-I indicated he did not wish to proceed with that matter. As of the date of this decision, the Tribunal had received no submissions on these matters from the respondent.

3The requirement to file a Response in Tribunal File No. 2010-05233-I has been held in abeyance pending further direction from the Tribunal. That application will now proceed and the Tribunal directs the respondent to file with the Tribunal and copy to the applicants a Response to the Application in Tribunal File No. 2010-05233-I, on or before July 25, 2011.

4Having regard to the Case Assessment Direction issued on June 17, 2010, and to the applicant’s letter of June 17, 2011, the Application in Tribunal File No. 2008-00579-I is dismissed.
