1The applicant filed an Application under section 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on April 20, 2011.
2On May 11, 2011, the Tribunal issued a Notice of Intent to Dismiss (“Notice”) to the applicant. The Notice advised the applicant that the Application appears to be outside the Tribunal’s jurisdiction because it was filed more than one year after the last incident of alleged discrimination. The Tribunal directed the applicant to provide written submissions on or before June 10, 2011 addressing the jurisdictional issue highlighted in the Notice.
3The Tribunal’s Notice further indicated that, if the applicant did not file written submissions by the required time, the Tribunal may consider the failure to respond as an abandonment of the Application and dismiss the Application for that reason.
4The applicant has not responded to the Tribunal’s correspondence, nor filed submissions in accordance with the deadline.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
