1This is an Application under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”).
2The Application was originally scheduled to be heard on March 18, 2011. At the request of the applicant, that hearing date was adjourned (2011 HRTO 545). A Notice of Hearing dated April 18, 2011 was sent to the parties advising that the hearing would commence at 9:30 a.m. on June 23, 2011. The Notice of Hearing was mailed to the applicant at the address provided by her to the Tribunal. It was not returned.
3The hearing began at the scheduled time. The respondents were present. The applicant was not. I advised those present that the hearing would commence at 10:00 a.m. or whenever the applicant arrived, whichever occurred first. At 10 a.m., the applicant was still not present.
4I was satisfied at the hearing that the applicant had received timely and proper notice of the hearing. I was not aware of any indication that the applicant would not be attending the hearing. In the absence of the applicant or any explanation for her failure to attend the hearing, I dismissed the Application as abandoned at the hearing.
ORDER
5The Application is dismissed.
