1This is an Application filed on September 30, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended.
2On October 5, 2010, the Application was scheduled for mediation. The applicant did not attend the mediation nor did the applicant call or otherwise communicate with the Tribunal about his absence.
3On December 21, 2010, the Tribunal wrote to the applicant indicating that he had failed to appear at the scheduled mediation and stating that he must advise the Tribunal of his intentions with respect to the Application. The letter concluded with the following caution:
The Tribunal draws your attention to Rule 5.4 of the Tribunal’s Rules of Procedure:
5.4 The Tribunal may finally determine an Application without further notice to any person who cannot be contacted by the Tribunal according to the contact information provided by that person.
If you do not respond within ten days of the date of this letter in writing, the Tribunal will deem you to have abandoned the application and close the file.
4The letter was sent by regular mail to the applicant at the address provided by the applicant in the Application.
5The Tribunal has not received any response to its letter and the time period for responding has elapsed.
6Having regard to the foregoing I find that Application is abandoned. The Application is dismissed.
