1This is an Application filed June 29, 2010 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended (the “Code”), alleging discrimination in employment on the basis of disability.

2On August 10, 2010, the Tribunal issued the Application along with Notice of Intent to Defer and sought submissions on deferral from the parties and the applicant’s union. The parties and the applicant’s union are not seeking deferral as there is no outstanding grievance relating to the issues in the Application.

3The Application will continue to be processed.

4The Tribunal directs the respondent to file a Response within 35 days of the date of this Interim Decision. If the applicant’s union, Teamsters Local Union No. 419, wishes to intervene it is directed to file a Request to Intervene within 35 days of the date of this Interim Decision.
