Decision
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on April 18, 2011.
2The respondents filed a Response and requested that the Application be dismissed under s.45.1 of the Code, on the basis that another proceeding had appropriately dealt with the substance of the Application.
3By letter dated April 21, 2011, the Registrar directed the applicant to file a Reply (Form 3) addressing the Request to dismiss no later than May 5, 2011. The letter warned that if the applicant failed to file submissions the Application might be dismissed as abandoned.
4The applicant has not responded to the letter and the time for doing so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application.
6The Application is dismissed.
