DECISION
Adjudicator: Sherry Liang
Indexed as: Sealey v. Toronto East General Hospital
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on July 29, 2010, alleging discrimination in the area of goods, services and facilities on the grounds of race, colour, ethnic origin, disability, creed and age.
2On April 6, 2011, the Tribunal issued a Case Assessment Direction (“CAD”), directing the applicant to take certain action in response to issues raised in the CAD by April 19, 2011. The CAD advised the applicant that the failure to comply with the directions in the CAD might be considered an abandonment of the Application. The applicant did not respond to the CAD and the time for doing so has now passed.
3In the circumstances, the applicant is deemed to have abandoned the Application.
4The Application is dismissed.
Dated at Toronto, this 27th day of May, 2011.
