1This Interim Decision addresses a disputed Request for Order During Proceedings (the “Request”) filed by the applicant on April 20, 2010. In the Request the applicant asks “For the Tribunal to amend the charges to include other types of discrimination that are seen in the complaints and documents submitted but which the Commission did not include”.
2On April 9, 2010, the Tribunal issued Interim Decision, 2010 HRTO 785 (the “Earlier Interim Decision”), ruling on a number of issues and denying the applicant’s request to amend his Application. In the current Request the applicant states that he was under the impression that when he transferred his file from the Commission the Tribunal would have the power to amend the charges not included by the Commission.
3The applicant’s request to amend his Application is denied for the same reasons set out in the Earlier Interim Decision. The Tribunal will not consider any further requests to amend the Application to include other allegations of discrimination or expand the scope of the complaint not originally stated in the applicant’s original human rights complaint, dated June 22, 2007.
