1This is an Application filed on June 2, 2009, under section 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”) alleging discrimination in employment arising in part from the applicant’s termination from employment on two separate occasions. By Interim Decision dated November 17, 2009, 2009 HRTO 1939, the Tribunal deferred the Application “pending the conclusion of the grievance process in respect of each termination grievance.” On March 3, 2009, the applicant requested that her Application proceed principally because of delays in the arbitration process. She makes specific reference to the adjournment of two arbitration dates in January and one in March of 2009. The respondents and union have not responded to the applicant’s request.
2Having regard to the information provided, there is no indication that the grievances have been concluded and accordingly, the applicant’s request to proceed at this time is denied. The Tribunal’s earlier decision governing the status of the Application remains in effect.
