Human Rights Tribunal of Ontario
B E T W E E N:
M.O. by his next friend J.O.
Applicant
-and-
Ottawa Catholic District School Board
Respondent
INTERIM DECISION
Adjudicator: Sherry Liang
Indexed as: M.O. v. Ottawa Catholic District School Board
1In this Application, the Tribunal asked for the parties’ submissions on whether the name of the applicant, a minor, should be anonymized in the Tribunal’s decisions and correspondence. The parties agree that anonymization is appropriate.
2The nature of the applicant’s disabilities and other personal information about him will be an important part of the issues in the proceeding. I am satisfied that the protection of the applicant’s personal information and the potential stigma of disclosing it outweigh the principle of open justice. The Tribunal will therefore refer to the applicant and his next friend by their initials in decisions and correspondence on this Application.
3The applicant has been identified in a previous Interim Decision of the Tribunal. In view of this order, the Tribunal will contact the legal information services to which it distributes its decisions and request that the previous Interim Decision be amended.
4The Tribunal confirms that the hearing in this matter will continue on Friday, April 23, starting at 9:30 a.m., at the offices of the:
Canadian Human Rights Tribunal 160 Elgin Street, 11th Floor Ottawa, Ontario K1A 1J4
Dated at Toronto this 19th day of April, 2010.
