1This is the second Request the applicant has filed requesting reconsideration of the Decision dismissing his Application, reported at 2009 HRTO 996. The first Request for Reconsideration is reported at 2009 HRTO 1610.
2The Request in essence repeats the substance of the applicant’s previous reconsideration request which was dismissed, and the Tribunal need not address these allegations, which express disagreement with the Decision.
3The applicant makes a new allegation as follows:
I understand recently, that both the responding party’s law firm and the former law firm of Vice-Chair Liang have not only represented the same union clients in the past, but on occasion have jointly represented some members of a union, as well as the union itself (OSSFT) during the same proceedings at the OLRB. This information was never shared with me, nor my representative by either Mr. Goldblatt or Vice-Chair Liang before the May 29, 2009 hearing, nor on May 9, 2009 before the hearing commenced (Perceived conflict of interest).
4There is no merit to this allegation. Vice-chair Liang has not worked in private practice for over 15 years. The type of allegation made by the applicant does not give rise to a reasonable apprehension of bias: see Guilmoutdinov v. Ontario College of Teachers, 2009 HRTO 2130.
5The Request for Reconsideration is dismissed.
