1This is an Application filed June 22, 2009 under section 53(5) of Part VI of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). This Interim Decision deals with a Request for Order (Request) seeking the production of documents, filed by the applicant on March 15, 2010. The hearing of this Application is scheduled to occur on May 7, 2010.
2The human rights complaint filed with the Ontario Human Rights Commission (the complaint) is dated October 3, 2003. The applicant alleges in the complaint that she was subject to harassment by the respondent in respect of her application for Ontario Works over a period of time between 2000 and May 2003. In her Request for Order the applicant seeks the production of her file held by the respondent as well as an extension of time to April 26, 2010 to deliver and file her list of witnesses and any additional documents.
3The respondent did not respond to the Request. The time for the delivery by the parties of all arguably relevant documents has passed.
4The Request for an Order requiring the respondent to produce a copy of Susan Saunders’s file with the Corporation of the County of Simcoe is granted. As the allegations in the complaint deal primarily with the handling of the applicant’s claim to Ontario Works benefits it is likely that her file may contain arguably relevant documents.
5The Request for an extension of time to deliver and file her list of witnesses and any further documents to April 26, 2010 is granted as well.
6The Tribunal makes the following Orders:
The respondents shall immediately deliver to the applicant a copy of Susan Saunders’s file with the Corporation of the County of Simcoe
The applicant will deliver and file her list of witnesses and will-says and any other documents upon which she intends to rely on or before April 26, 2010.
