INTERIM DECISION
Adjudicator: Michelle Flaherty
Indexed as: Salerno v. Toronto (City)
1The applicant filed an Application under s. 34 of the Ontario Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), alleging discrimination based on disability and age in the context of employment. He also alleges reprisal or threat of reprisal.
2In the Application (at question 14), the applicant states he has filed a grievance and asks that the Application be deferred pending the outcome of the grievance proceeding. The respondent supports the request for a deferral.
3In the circumstances, I agree that a deferral is appropriate. Accordingly, the Application is deferred pending the determination of the grievance.
4The Tribunal directs the parties’ attention to Rules 14.3 and 14.4, which outline the procedure by which a party may request that the Application proceed.
5I am not seized of this matter.
Dated at Toronto, this 1^st^ day of April, 2010.
