1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”). The Tribunal conducted one day of hearing, but the matter was adjourned and the Tribunal ordered the applicant to disclose to the respondents and the intervenor parties recorded evidence that the Tribunal deemed arguably relevant to the Application.
2The applicant sought a reconsideration of the Tribunal’s decision regarding disclosure. This request was denied.
3On February 25, 2010, the applicant filed a Request to Withdraw the Application against all parties.
4The respondents submit that, in the circumstances and based on the applicant’s repeated attempts to litigate the same matter in different venues, it would be more appropriate for the Application to be dismissed.
5The Request to Withdraw is granted.
6While I appreciate the respondents’ concerns, I find that there is no basis to dismiss the Application.
