1This is an Application filed on November 2, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the "Code"). The Application alleged discrimination in employment on the grounds of record of offences.
2"Record of offences" is defined in section 10 of the Code:
"record of offences" means a conviction for,
(a) an offence in respect of which a pardon has been granted under the Criminal Records Act (Canada) and has not been revoked, or
(b) an offence in respect of any provincial enactment
3On February 5, 2010, the Tribunal issued a Notice of Intent to Dismiss to the applicant. It directed the applicant to provide submissions to clarify how she had experienced discrimination on the grounds of record of offences. The Notice advised the applicant that if she did not make submissions by the required time, the Tribunal would make its decision based only on the information in the Application or consider the failure to respond as an abandonment of the Application.
4The applicant has not provided any submissions and the time for doing so has elapsed.
5In the circumstances, the Tribunal deems the Application abandoned and it is accordingly dismissed.
