1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on June 4, 2009, alleging discrimination in employment. On November 25, 2009, the Tribunal issued a Notice of Intent to Dismiss under Rule 13.2 of its Rules of Procedure. The Notice states that “the Respondent appears to be a federal government department, agency or a federally regulated business or service”. The applicant was invited to make written submissions on why her Application should not be dismissed.
2The Notice advised the applicant that if she did not make submissions by the required time, the Tribunal would make its decision based only on the information in the Application, or might consider the failure to respond as an abandonment of the Application.
3The applicant has not provided any submissions, and the time for doing so has elapsed. In the circumstances, the Tribunal deems the Application abandoned and it is accordingly dismissed.
