1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), on September 28, 2009, alleging discrimination with respect to services, goods and facilities because of receipt of public assistance.
2On November 18, 2009, the Tribunal sent a Notice of Intent to Dismiss (“Notice”) to the applicant. The Notice stated that the Application appeared to be outside the Tribunal's jurisdiction as the Code does not prohibit discrimination on the basis of receipt of public assistance in the area of services, goods and facilities. The Notice indicated that the applicant must provide written submissions responding to this issue, within 30 days of the date of the Notice. The Notice also stated that if the applicant did not provide submissions within the required time, the Tribunal may consider the Application to be abandoned and dismiss the Application.
3By correspondence dated December 16, 2009, the applicant requested an extension of time to respond to the Notice and, on January 7, 2010, the Tribunal granted an extension, until January 25, 2010, for the applicant to provide submissions.
4As of the date of this Decision, the applicant has not provided submissions in response to the Notice. In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
