1This is an Application under section 53(3) of the Human Rights Code (the "Code"). It was filed with the Tribunal on December 26, 2008. The underlying complaint to the Commission is dated August 23, 2005.
2On February 2, 2010, the Tribunal received correspondence from the applicant's former counsel stating that it no longer represented her in this matter and accordingly would not be attending the mediation scheduled for February 11, 2010. As a result, the Tribunal wrote to the parties on February 2, 2010 advising that the mediation scheduled for February 11, 2010 was adjourned and directing the applicant to contact the Tribunal within 20 days of the date of the Tribunal's letter if she intended to proceed with her Application.
3The applicant was further advised that, if no communication was received from her by the Tribunal within this time, the Application would be deemed to have been abandoned.
4To date, no correspondence has been received from the applicant confirming that she intends to proceed with this Application. Accordingly, the Application is hereby dismissed as abandoned and the Tribunal will close its file in this matter.
