1This is an Application alleging discrimination in employment on the grounds of race and place of origin contrary to the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”). A hearing was scheduled for February 23, 2010 commencing at 9:30 am at the Tribunal’s hearing centre in Toronto.
2The applicant was not present at the hearing. In accordance with its usual practice, the Tribunal waited until 10:00 am before proceeding.
3I am satisfied that the applicant had notice of the hearing. In addition to the Confirmation of Hearing notice, the Tribunal issued a Case Assessment Directions in this matter confirming once again that the hearing would proceed on February 23, 2010. None of these documents were returned to the Tribunal.
4In view of the applicant’s non-attendance, the Application is dismissed.
