1This is an Application filed on August 10, 2009 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19 as amended, (the “Code”).
2On review of the submissions of the parties and of the proposed intervenor, the Canadian Union of Public Employees and its Local 3083 (the Union), the Tribunal determines that it will proceed with the Application rather than deferring to the grievance process. No one takes the position that the Application should be deferred, it is not clear that the human rights issues raised by the applicant are part of the grievance process, or that the applicant’s grievance will proceed to arbitration.
3The Union’s Request to Intervene is granted. It will accordingly be given notice of the mediation. The extent of its participation at a hearing, if any, will be determined by the Vice-chair assigned to hear this Application.
4A Notice of Mediation will follow under separate cover.
