1In this complaint, the Tribunal held a Case Conference Hearing on February 23, 2010. Based on the agreement of all parties, new hearing dates were set in this matter, for September 8, 9, 10, 14, 15, 16 and 17, 2010 (September 10 being subject to confirmation from counsel for the respondent William Blair).

2The complainant now wishes to re-schedule the hearing, and seeks earlier hearing dates. The Tribunal will not address the request to re-schedule the hearing now. If the mediation in this matter does not result in a resolution of the complaint, the parties should consult with each other about any outstanding procedural issues, including the possibility of earlier hearing dates.

3At the hearing on February 23, the parties also agreed to consult with each other on the deadlines for the respondent William Blair to file a hearing brief, provide disclosure and deliver a document book and list of witnesses, in the event that the matter is not settled.

4If, following mediation, this complaint is not settled and the parties are unable to agree on the procedural matters described above, the Tribunal may issue further directions or convene a further case conference.
