1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, (the “Code”), on April 15, 2009, and the respondent filed a Response on June 10, 2009.
2A mediation was scheduled for October 8, 2009, but did not proceed because the respondent was not available. The Tribunal Registrar contacted the parties to ask for alternative dates. The applicant did not respond. The Tribunal issued a Case Assessment Direction on November 26, 2009, directing the applicant to advise the Tribunal of her intentions with respect to the Application within 15 days. The Case Assessment Direction stated: “Absent any advice regarding her intentions, the Application will be deemed to be abandoned.”
3The Tribunal has not heard from the applicant.
4In the circumstances, the applicant is deemed to have abandoned the Application.
5The Application is dismissed.
